I agree. I wish we knew more about the infringement arguments after the judge stuffed the motion to dismiss.

Of course the generics witness was a half-time cardiologist and half-time policeman. They couldn't even get a full-time cardiologist to agree with the absurd idea that doctors would routinely prescribe it for less than 12 weeks.

I think they thought naively that since the guy was a veteran the judge would just say, "Thanks for you service. Whatever you say is like gold. No infringement? You got it, soldier!"

People think like that. Mom, hot dogs, apple pie, Chevrolet, veterans, and absence of infringement.
