Some of the differences between law as practised on TV and in the courts;
Every loser says, "We'll appeal." But grounds for appeal have to be something besides, "We lost and we didn't want to."
In the case I wrote about above, (the above excerpt is from my co author) the losers DID find something real. The damages award used the same legal basis/formula for tangibles and intangibles and the appeal court overturned the award as that was not the law. But they did not overturn the trial outcome. There was a lot of dancing and song on the losers side until it was pointed out that all the losers had won was a chance to pay for a redo the trial in front of a new jury (the jury was long gone) and once that new jury had heard all the evidence and had been instructed to render a guilty verdict, to argue over the size of the award. Which now would include legal fees for two trials, the second trial outcome a foregone conclusion.
There will be more lawsuits and prolly appeals, but not the same trial over and over and the arguments should get weaker...
