Montana I believe you are right but as I understand it the defendant’s argument is just that there was factually incorrect information used in deciding the validity of the patents and therefore if he had known the truth that MIGHT have changed his decision (extremely unlikely, but that appears to be their argument). I will let the lawyers here give a better account.
