Actually, the length of time for enforcement discretion seems to have been reduced from 120 to 60 days! This could be great.

the agreement includes $2,000,000 for research, policy evaluation, market surveillance, issuance of an enforcement discretion policy, and appropriate regulatory activities with respect to products under the jurisdiction of the FDA which contain CBD and meet the definition of hemp, as set forth in section 297A of the Agricultural Marketing Act of 1946 (7 U.S.C. 16390). Within 60 days of enactment of this Act, the FDA shall provide the Committees with a report regarding the agency's progress toward obtaining and analyzing data to help determine a policy of enforcement discretion and the process in which CBD meeting the definition of hemp will be evaluated for use in products. The FDA is further directed to perform a sampling study of the current CBD marketplace to determine the extent to which products are mislabeled or adulterated and report to the Committees within 180 days of enactment of this Act.

Well first of all, thanks for the post. Good info in there. I guess I have many thoughts to work out, but in regards to the spending bill one word for me sums it up. Lacking.

looks like they prefer the states doing all the hard work, and they'll just piggy back on what they do later... typical fed process. watching what states do over the next few months could prove far more interesting and helpful in the end.

That is an obscene amount of money for research, policy evaluation, market surveillance, issuance of an enforcement discretion policy, and appropriate regulatory activities. How many people work at the FDA? Let's say each man hour is charged at $400/hr. That is 500,000 man hours or enough budget to support 496 people for 6 months. Or $200/hr to support 496 people for six months and leaving 1B for testing. You sure its not 200M?

Very ambiguous IMO. If the FDA does not act in good faith (Protecting 3rd party), they could drag this longer.

It doesn't say when the enforcement discretion policy will be issued.. Any ideas????
