And that's where we part ways as they absolutely do not have to disclose a contract if there is an NDA.

I have contacted the SEC as you suggested. The SEC says the following:

Examples of the events that trigger the filing of a current report [Form 8-K] are: entry into and termination of a material definitive agreement (a copy of the agreement must also be publicly filed)

There is no NDA exception. The SEC is clear - a copy of the agreement MUST be filed.
