This (if true) is COMPLETELY IRRELEVANT to the current case.

The ALJ has made her ruling. This is now between the Enforcement Division and the SEC Commission.

She could be the Chief or the most junior. What MATTERS is this: if the Commission grants the review, she will have some explaining to do.

If you actually read the ENTIRE Request for Review (from the Enforcement Division to the Commission), Foelak hasn’t a leg to stand on. She ignored all the Normal procedures usually applied to Respondents who fail to file, and made up her own “yardstick” as to why she was letting DBMM off the hook.

I think the petition for review will be granted and Foelak’s decision will be overturned.
