In a lot of instances, creating the arbitration panel takes quite a bit of time. Conceivably, the panel has already been chosen and is in place. The only reason that I have for saying that is that there had to have been some body that granted NOK's request for an extension of time, until Judge Lynn had ruled. If in fact, the panel is named, that could shorten the arbitration process considerably, once that it starts.
