This Mordicai, do not underestimate. In my view, the UWs are trapped. They can risk gambling on a Hearing that may not happen while gambling on an outcome where they are legally the underdog. Nothing says the Appeals court cannot just issue an opinion at anytime.

If I were handicapping this, the UWs have already won by being placed in class 19 (worst case w/consensual agree is class 22) and to seal this victory without being concerned with the outcome, even if they already think they know the outcome (people have been wrong twice about so-called known outcomes), is to guarantee an outcome is to have a consensual agreement which would be effective immediately upon court signature.

To me, anything other than a consensual agreement is to take a 100% win gambling on something better while taking a chance at losing 100%. I do not take these people as fools, so I say a consensual agreement will ultimately happen between Alice and the UWs.

The third circuit doesn't pay on Security indemnity claims historically do they!!!!!

They imho have a 300 ft rock wall to climb that has a 1,000 ft drop on the other side!!


They have no placve to go, I still suggest they settle!

Mordi will you chime in on the lack of the UW's & lawyers NOT being CC'd in HOSENS response to the courts and is this NORMAL or way out of line?

And what does if IF IF anything does it indicate to you?

Why couldn't there be 1% of any funds disbursed to the P's' placed in Escrow pending a Settlement or a Final Ruling of the last Court that this objection is appealed to. Seems simple enough!

"If I recall correctly the LT issued a press release when Piers were issued their LTI's. Have LTI's even been issued to Class 18 yet?
Has Class 18 been paid?

If the district court rules in Alice's favor will the LT appeal that decision? If the district court rules against Alice, will she take it to the appellate court?

Seems to me the bankruptcy will not close this year."
