Mark stated that the name would change to the same name of a company that he already created, which cannot happen since the company already exists. Thus it would have to be a merger. If he had filed with the SOS for a name reservation instead, it would be different. But he filed as a full fledged corporation, so legally he is stuck. But then again, when has Mark worried about legalities.
