The lawyers would have a field day with it due to the pre-announcement.

At this point, the company knows their numbers. They still have to go through the audit, since it is a filing for the full fiscal year, but the numbers are in front of them. If they put out a pre-announcement knowing they will beat previous expectations, there would be some serious legal issues.

That's why companies don't do it.
