The processes quoted, Safe Harbor, True Sales, Bk Remoteness, SPE's etc all do exist as means of securing assets, the problem is they do not apply to WMI/WMILT or us.
What I believe occurred was that WMI never believed they would be seized and co-mingled their most valued assets under the control of WMB as a means of stabilizing the bank's finances.
This is what inevitably resulted in virtually all their assets being seized and sold to JPM by the FDIC. They screwed up royally!!!
