TDA- north, if you have a margin account with TD Ameritrade, by the terms of the margin agreement, they have the right to loan out your shares, no matter what the person at the end of the 1-800 telephone tells you. Now, if you have a cash account w/o margin privileges, then they can not loan out your shares for shorting purposes.
