For the last 25 years the SEC has posted warnings on their web site against investing in penny stocks with non-substantiated claims regarding investment potential. OTCMarkets puts a STOP sign on OTC listed stocks for the same reasons. Courts do not look favorably at people that ignore the warnings and invest in things they don't understand (or think they understand).

Individual lawsuits or class actions will not even make it into court unless the accusations can be supported by documented evidence of fraud (including the hardest part to prove, intent to defraud). The supporting evidence usually has to be obtained through court ordered subpoena, issued to the defendants, who are in sole possession of key documents needed to prove a case.
