Again...they are being judged on their past not the present.



They only hoped that the present filings, not current by the way and SEC questioned, would sway the judge in their favor.


Not unlike continuously robbing banks, getting caught but writing a note to the judge to say that you won't do it anymore in hopes that he/she gives hugs and says 'its ok I forgive'.
