Losing the appeal doesn't mean Carter will take a smaller settlement or even any settlment rather than go to court. After all these years I can't see him settling for basically peanuts. No reason not to move forward with scheduling the trial even if the one appeal is lost.

IMO, yes but I think the $500MM stays on the table, Billy goes to trial with anything less.
