October 24, 2017, a scheduling conference was held. The parties agreed to, among other matters, to exchange documents and conduct other discovery, and to schedule a bench trial to originally start June 11, 2018. On March 12, 2018, the parties agreed to extend the discovery period to September 7, 2018. The bench trial is now set for February 11, 2019.
RedHawk plans to vigorously contest the claims against it in this matter and to pursue the claims against Schreiber, individually and as Trustee of the Schreiber Trust.
While we are insured for our legal defense costs in this matter, we have a $250,000 self-insured retention. During the year ended June 30, 2018, we recorded a charge of $250,000 for costs that may be uninsured that were incurred in connection with this matter. As of September 30, 2018, the remaining accrued liability related to this matter is approximately $145,000. We believe the ultimate resolution of this matter will not significantly adversely affect our financial position, operations or cash flows, other than the costs referred to above.
