#28397 RE: XNRGI2008 #28396

D'Couto would have never mentioned a short time frame unless he was truly working to a near end point. Why commit himself if he can string it out if there were to be legal issues. Just have a little more patience. HeadOfCapital spews about suing every time he posts. Go ahead, waste your time. It quickens nothing. It solves nothing. He isn't doing s--t. The people who blab about suing every 2 seconds never end up doing jack. Again, D'Couto would not have used such a short time frame of 2 weeks if there was not a near end-point. Now, if this continues another month or so with nothing, a group should form and engage with a knowledgeable person in this field unless one of the group is an attorney (preferable). We wouldn't even know where to file this claim. Nevada? Washington? Lots of opinions but we don't know.

There are some caveats to the going private.

Things that need to be accomplished as always in DCouto land have not. Yes with the reverse he got the shareholder count most likely under 300. He appears to be able to take this private.

However even though he filed the FINRA corporate action, it is not complete. he has not made the exchange and has not compensated fractional holders.

Once again DCouto has not executed fully.

I am waiting till end of January to initiate anything, but I am willing to be a part of a group action after that. The best bet is to get a FINRA lawyer on these guys as they have skirted the rules quite blatantly.
