Yes, that's the requirement. And if the CBD is derived from cannabis, it can only be sold in legal cannabis (recreational and/or medical) states. The more cannabis is legalized the weirder the laws get, trying to split hairs. EDIT: The CBD is the same stuff once extracted, whether from hemp or cannabis. The very same healing properties and the very same lack of psychoactive effects.
