you're missing the point that owners of CJV have no actual equity ownership war legal claim to assets within the CJV so there is no equity in the CJV there is no control in the CJV with foreign parties and thus there is no asset claim within a XJV. it's a worthless handshake and the SCAMCO claims it's a marriage with certain assumed rights. there are no rights. ask a lawyer. some dozen Chinese and HK based PE firms confirm what we have known for years.
