JT in the last call mentioned their IP blocks Epanova but then before he has said that if they succeed it will be a good thing as it would build the entire market class. Which one is it?
This is JT executing "The Art Of The Deal". The only way for AZN to sell EPAnova is:
1) win the IP case in court
and/or
2) permission from Amarin
There is no #3.
1: AZN lost in 2015 and chose not to pursue since then.
2: Money talks. AZN would have to throw in a very substantial amount, Amarin wouldn't accept anything that would favor AZN.
Partnership / BO is the only thing that makes sense.
What exactly is the blocking IP which keeps Epanova off the market.
This is an action for declaratory judgment of infringement of United States Patent No. 8,663,662 (“the ’662 patent”) under 28 U.S.C. §§ 2201 and 2202 and 35 U.S.C. § 271.
Please note: AZN did not lose, Amarin did not win … the case was dismissed (requested by AZN as sell of EPNOVA is not imminent).
JT in the last call mentioned their IP blocks Epanova but then before he has said that if they succeed it will be a good thing as it would build the entire market class. Which one is it? We want you to succeed to build the market or we want to keep you off the market?
The successful STRENGHT result will build the entire market class … the study result itself (not EPANOVA on the market). So the answer: both.
