The way I understand the convertibles is that BIEL gets the money and the lender has to wait 6 months before any shares are available to sell.

Actually it seemed like a prudent course of action to me. The purpose of the Pre-Submission process is to identify any obstacles to a successful 510k application. A large part of the Pre-Submission was the FDA review of the Clinical Data. As one can see from the PR the FDA gave no indication of any problems with the Data during the Pre-Submission.
