FDA and Marijuana: Questions and Answers

There is an exception to sections 201(ff)(3)(B)(i) and (ii) if the substance was "marketed as" a dietary supplement or as a conventional food before the drug was approved or before the new drug investigations were authorized, as applicable. However, based on available evidence, FDA has concluded that this is not the case for THC or CBD. What available evidence? Why is their "available" evidence not referenced? Does anyone know?

Deetew: the simple answer is they have been doing this for years (and increasingly) so. Hence, they can.

I think the reason CVSI has not been "shouting it from the rooftops" is that they recognize that FDA is in a challenging place, having recently approved CBD for GW Pharma, while not stopping CVSI and other companies from selling CBD.

Technically, they've been selling a schedule 1 substance at nearly 2000 heath food stores, with little resistance. Go figure.
