Attia filed an amended complaint on the 13th of August along with a stipulation that it be dismissed. Attia conceded that the amendment wouldn’t fly given the ruling of the court, and filed it for purposes of appeal. Attia said it had Google’s agreement to withdraw the claim. It didn’t. The stipulation was dismissed.
The amended claim was filed. However, it can’t succeed given the court ruling, as even Attia acknowledges. Next will be a motion to dismiss with costs. Costs may be substantial, adding to the in excess of $800k owed to Google and subject to on going enforcement proceedings.
