Anything the defendants continue to say to the public can and will be used against them in the court of law. Their attorneys should have made them aware, then again, they should have been aware that MYDX had substantial evidence before they motioned the demurrer. Hmm. Or they could have just gone straight to court, why try to avoid it? If the defendants actually believed it is a frivolous case, they would not have to retaliate against the company just because they lost.
