All Arris has lost is the ability to invalidate the patents at the PTAB, they havent lost the ability to show they dont infringe them, remember that going forward. I am not quite sure why you are bringing up the PTAB actions, that was not the point of my post. My basic question was if Comcast was alerted to their infringement in 2012 and ignored it, and knowingly used the tech, they are obviously willfull.
If they used Arris equipment, but Arris was unaware of infringement until 2015 or so, is Arris willfull as Comcast? Has nothing to do with the PTAB.
