If a273 is successful they will start studies with the enantiomer a few years or more later financed out of cash flow so that the enantiomer would be approved before regulatory exclusion or patent life expires. This is common with drugs that have a chiral carbon and hence enantiomers

Do you mean to say that this example (#5) has been used n previous A2-73 patent apps? I'll admit I have not read every single patent detail app.text from the past but have to believe this would have jumped off the page before now.
