Proper procedure? LOL as we all know, proper procedure is not always the best way to do things. Filing a motion to dismiss is a complete waste of time. Mersky was smart enough again to realize if they didn't respond it would be thrown out. Why waste time filling out documents? Also, it would not be the Prosecution filing the Motion to Dismiss, it would be the Defendants in this case. And as we can all see that didn't happen.
