It is very probable that at this stage in the game the merger company is already selected.

A judge wouldn't use the words "very real and attractive package" to define an empty shell with no merger candidate. That wouldn't make sense.

The merger has likely been a done deal for a while now, it's just the matter of process at this point.

As to what exactly the company will be, I'm waiting to see like everyone else.
