The Supreme Court just ruled that patents are not private property. Why are you harping on the issue? I disagree with case ruling, but they ruled in spite of many amicus briefs filed by academia, inventor organizations, private patent holders and companies arguing the private property characterization. As a young lawyer, a case came out that completely gutted my case and I argued with the judge that it was wrong. He told me to look up the T S doctrine. I asked him where I could find it and he said it is unwritten but the T stands for tough and S ends with a T.
