I think we would have seen Cisco succeed on that basis if it were possible. They did try and pick at certain words and did not prevail. What they prevailed on was all based on one deposition from a PhD saying it was of ordinary skill and art to put the pieces together. Which I still have a hard time with. You can’t patent something you invent because it would have been easy to somebody else at that point and time?
