The only problem with the new appeal is they may stay the court trial until the CAFC appeal is decided. See WD*DD, same boat. As of now, the CAFC hearing/decision won't happen until next year. If the trial is on time, those claims will stay unpatentable. Of course, unless it is a negotiation tactic.
