I would also agree, but with a caveat.
Like someone else mentioned earlier, IP cases are usually taken on contingency. It wouldn't cost them anything to pursue compensation for the infringement while also moving forward with their business plan.
Art is right, it would most likely take a bit of time, but it is potential money in the bank that comes at little to no cost and little effort on BRK's part. I think that is at least worth factoring in.
