are they running the risk of fresh 3G litigation from IDCC (and possibly other holders of essential IPR)?

yup....but on the whole the industry is OK with delayed licensing until all gets hashed out through 3G3P and their certification groups. If there is no doubt about a patent or 2, then the hold up would be on the overall licensing package.

jaykay, and if I were sitting in the "big chair" at one of the manufacturers I would not be real concerned with "running the risk of fresh 3G litigation" based solely on past results with IDCC in any type of litigation. I'd especially be willing to roll the dice when few or NO others were paying.
