If the court adopt de nova review, then there is a very high probability that the court will vacate the board's ruling. But the big unknown for me is how likely will the court apply de nova review?
Judging form the oral hearing, one justice stated that the board action in contract interpretation is illegal (did I hear that right?), and Bungie's counsel admission of no evidences to refute the RPI issue, then I think the court should apply de nova review standard.
