LOL, no it's not. The defense stated eight reasons for the case to be tossed based on a prima facie basis. If the five Causes of Action are sustained, that could weaken if not eliminate, the basis of an extortion claim as defined in this specific case with MYDX.

Well, at least the finding about the MYDX case has at least been....uhhhh...."updated" from......

Demurrer overruled on all counts.

Fact of the matter is the defense has 30 days to respond. We don't know if the rulings on the other five Causes of Action are being delayed pending that response or if there are other mitigating circumstances.

Who knows, maybe the case will go to trial. But from what has been put out in the SEC filings, I'm not sure I'd want defense lawyers digging deep into the MYDX financials and asking questions under oath.

The lawsuit is NEXT Year.. hell MYDX could be bankrupt by then!

and with Yazie spending money on a lawsuit unnecessarily... BK is an option.

The lawsuit has only been for the investors that he wants to fool, nothing more, nothing less. All a bunch of smoke and mirrors.

Yazie and the two defendants are all very shady.. imnsho.

They all deserve each other.
