Also, the investigation has been going on for a while now. IMO the company "hoping it will be finished this year" suggests at least this possibility. This being the case they must by now be fully aware of any and all issues raised and are confident they can be resolved. If there was any chance of the SEC "shutting down NWBO" I would have thought all insiders would already be selling their shares:-)
