My take: filing the 3rd. quarter numbers will come sooner than expected. The company is not waiting for the resolution of the court case.

I'm with ya. The problem, and this is just my supposition; the company is not going to release any substantial information until these suits are resolved. If they are willing to go after the 54 million shares to recover them, they are certainly not going to release information that will raise the price of the stock significantly and allow those people to be able to sell them and profit from them into the increased price.
