I think your negative scenario is more likely as well, they never released details on the MS settlement, why would they release anything this time?

Based on my experience w/sfor, I don't believe theres enough public exposure for the win to have already impacted price. If it's a legit settlement it should attract a ton of buyers -- way more than those who pushed the pps to .03 on premature expectations. Doesn't even have to be a blockbuster deal... a few million & an agreement for royalty % would set nice precedent moving forward. Anything like that should light a fuse as word spreads, especially w/ 6 other cases pending.
