They do have a representation agreement with EA, in which EA sold his claims to MaxD. (According to a press release). And MaxD did sue Google and others on the basis of the EA claims. But that claim was dismissed. MaxD is still a plaintiff, which is odd because according to MaxD the claims were sold and MaxD has the exclusive right to pursue them.

VLL is the party on the appeal to the patent board decision, and on the case before the German patent court.

Fair enough. From the 10K it appears MAXD pays the legal bills and gets 50% of proceeds from patent litigation & licensing.

This implies MAXD is not entitled to any award for breach of contract. Although I suspect Attia is a fair minded-man who may split that portion of an award regardless.
