Thanks for posting that HDG - for those who may not easily be able to read PDFs, here's the text - one odd thing about this - note the [e] in front of "xceptional" - that means either someone edited the original text to correct a typo, or the ITC guidelines don't actually contain the exact word "exceptional" - could mean nothing, but hard to believe Mr. Barton doesn't know how to spell that word. In any case, w/o checking the entire GoogleDrive folder, do you think someone asked for this delay, meaning one or more of the respondents requested more time to file, or did the delay come from ITC itself after it realized this is a very complex issue involving FDA, directly or indirectly?
Re: Complaint Filed by Amarin Pharrna, Inc. and Amarin Pharmaceuticals Ireland Ltd. Concerning Certain Synthetically Produced, Predominantly EPA Omega-3 Products in Ethyl Ester or Re-esteri?ed Triglyceride Form (Docket No. 3247)
Dear Mr. Telep:
Under Commission Rule 210. 1 0(a)(l), the Commission may extend the deadline for voting on institution of an investigation when “[e]xceptional circumstances preclude adherence to a 30-day deadline.” 19 C.F.R. § 2l0.l0(a)(l)(i)_. Having found that such circumstances exist, the Commission has determined to postpone the deadline for determining whether to institute an investigation. The new deadline is set for October 20, 2017.
Sincerely,
Lisa R. Barton
Secretary to the Commission
