~ Nosch, Within My Conclusions, and In My Opinion ? ~

Judge Walrath made her final Plan 7 Approving, decision to be specific to the issues that had been presented in front of her ? ... as well as, her own previously written, precedent setting' rulings regarding Bankruptcy Rule 510, ... the mandate for a proper class subordination, when a Court considered the Class distributions aligned with a reorganization' ... specifically, in our case, ... Rule 510(b) ... or, as is specified, after all WMI creditors had been addressed, in our own Tranche 5 Class 17 and Class 18 ...

briefly, ... this is what lead to Judge Walrath NOT' being able to compromise her own precedent setting rulings, and the now experienced failure of Plan 6 as it had been presented' ...

The "dual tracking" litigation going on in D.C (Judge Collyer) was a very important part of the process' ... and if' ? disregarded or missed ? could have lead one to a possible poor investment decision' ...

The WMB (Bank) Noteholders' ... REFUSED to accept a debtor representation offer' to accept a Plan 6 Class 12 "General Unsecured" nomenclature' ... and, The WMB Bondholders, actually FORCED Rule 510(b) to be adhered to' ... Judge Walrath needed to abide by her own dissections, she had previously written in regards to Rule 510' ...

ALL creditor classes of the filer (WMIIC & WMI) were to be in line for a recovery first' ... (in our case ?, Tranche 1 thru Tranche 4)

Next ? ... would be a continuation of participants beyond the original filer' (s) ... (in our case ?, Tranche 5 ... WMB issues)

and finally, the true ending class participants of the original filers, ... (or in our case ?, the WMI Preferred Series and the WMI Parent Corp, common shareholders, Class 19 and Class 22) ...

So, Do I believe that Judge Walrath did anyone any "favors" ... ? ...

My answer would be ... No', ... I simply believe that Judge Walrath followed specifically and true to form, the actual Bankruptcy Law' ... that she had a part in fine tuning herself prior to the WaMu issues' ...

... Helpful ? ...
