Ron, I'm a little confused. How can WMIH negate the tax losses without directly getting back the capital gain. Also, in the scenario you are suggesting, where escrow gets the cap gain, and WMIH loses the NOLs, wouldnt that leave WMIH worthless?

RON

""Damages, 'willful misconduct' = 3X <-""

Ron you do KNOW what the actual damages are to WMI do you not???????????????????? IMHO Plain and simple we lost our bank we even stated in CORT that value was 24 bill ,so as far as I CAN SEE, they may 3x's the 24 bill , but past that we are getting back everything else and those have per your and AZ's own words have been moving forward collecting rev's anyway so NO HARM NO FOUL there, as those will come home to ROOST!!!!!!!!!!!!!!!!!!!

Let' compare it for example to the MARTA CLAIM!!!!!!!!! They attempted to claim WHAT THEY WOULD HAVE EARNED over the life of their investment and not their actual LOSS, I believe all they were given was their ACTUAL LOSS weren't they

I like this figure. 3 X assets
So JPM will pay this amount to us, then JPM will keep WMI's assets. Or JPM will pay the damages we still free by our own?

Thank you Ron but safe harbor assets are not part of the final payment. Safe Harbor assets were shielded from bankruptcy court and FDIC-R from day 1. They were never confiscated. So when these assets return, do they belong to escrow or WMIH?

ron you posted, "Damages, 'willful misconduct' = 3X"
Do you feel Susman may be pursuing this. If not, should he? Also, didn't the releases eliminate this possibility?
