Constance Nash is founding partner and president of VSL Communications LTD. Her Optimized Data Transmission System and Method’s inventions in Partitioning and Slice, plus software and coding is the foundation to the Mobile Wave starting in 2001, and continuing with non-obsolete data transmission technology for reducing all data to transmit via the narrow bandwidth of the Internet: hers is the foundation of the Technology pyramid, and hers is still growing with her own innovations and new inventions.
Ms. Nash draws upon nearly 30 years in the international communications industry, film industry, and as a pioneer in the Internet.
Initially, Ms. Nash became involved in VSL’s growth through developing Mo’Rhythm Palace, which was to be the first online concerts subscription music business. Until she learned that there was no software to license, that nobody had an online music video business because there was no way to transmit the videos of the concerts. The problem was Internet bandwidth was too narrow to transmit videos or images or music – or anything. Her tier-1 law firm in entertainment and technology informed them that her and Alex Krichevsky’s solution for transmitting data through the Internet was an invention they called The Holy Grail. Valued at $50 billion in 2001: IF she could write a patent and IF she could make the Software. “That-there was an international race to find the solution to reducing data to transmit low bit rate, non-buffering, problematic LOSSY AND LOSSLESS data: lossless means no loss of data being sent.” But, her inventions only transmitted 3% percent variable down to 1% of the received data, and yet there is no lost data: VSL’s are lossless. Considered impossible.
That gauntlet was thrown at her feet – so, she built one component upon the next until she had the only woman created (or male too) global chessboard of “no-prior-art” uber patents for new satellite broadcasting; semiconductor chipsets, smart phone, cloud, eBooks, music transmission, and more – the first in the world and necessary to the Internet – software, applications and innovations. This breakthrough Partitioning and Slice, now famous, hadn’t existed in the field of data transmission. Wasn’t taught in university, no engineer could be hired to help build it with her. She said she didn’t realize when Akin Gump Strauss Hauer & Feld LLP, Century City said all you need is a patent, which they could and did write, and software she should create, that she had embarked on the most difficult job in her globally successful career . Would she do it again? No, she says, big tech firms are the biggest and baddest shark infested waters in the world of business. They make “Liar’s Poker” look like Monopoly.
However, with the patent called The Holy Grail, and all of its foreign filings and globally tough prosecutions that lasted a decade as pending, to First Office Action ‘examination’ notification, to years in time sensitive global examinations, took years from her holidays and family and alternative happier experiences. Mainly she explains, Examiner’s of patents aren’t there to grant a patent per se, they are there to determine whether it is innovative, whether it evolves from known ‘art’, inventions already granted, or a part of an invention, in which case and in 99.999% of all technology patents, is the case: they are prior art inventions, have to be narrowed, claims have to be eliminated and then the strength of the original patent is watered down.
Hers are all granted. Nobody granted them happily except Australia after exhausting all global possibilities searching for prior art, they were granted just as written by the patent lawyer at Akin Gump. She co-prosecuted Australia patent, and all patents by flying to each patent law firm to teach the invention, so it could be protected. She fought for its and her rights. But patents were just the tip of the iceberg of the VSL in development achievement; software was and is brilliant. It is the key to the bundle of assets value. The applications she came up with, such as an image chipset inside a surveillance systems camera, when all security system cameras had external cables, changed how surveillance succeeds. That invention was not for a bandwidth transit usage on just the Internet. It proved the broad usage of the inventions themselves. Film used to be delivered in a can, sent in costly film strips to theaters. Today movies can be sent digitally, to equipment she envisioned years ago. She wrote of this in her White Paper too, and showed the concept and the patent to Universal. A long while ago, she says.
She knows now, that one person alone cannot grow a family of international patents through all of the travails and time lines of world-changing patents. Prior “art” means “a prior (art) patent taught this invention. But hers are: ” A “No-prior art” , which means nothing taught it. That status in data transmission is astounding.
Constance Nash grew them alone. She hired and fired patent lawyers, most couldn’t understand the simplicity of the inventions because she believes, they hadn’t learned of it; their universities didn’t teach partitioning macroblocks and slice to reduce data for the Internet. She spawned another field of use: today, schools teach her inventions as essential to electrical engineering and computer science curriculum.
She is recommended for this Worldwide Who’s Who acknowledgement because her software, her intellectual property and its applications are relied upon by all Militaries, all State Departments, all Governments, all Banks, all Mobile Phone makers and users, and textual Apps, all video transmission, all music and audio transmission and businesses, all Social Media, all Tablets, all Standards: cellular, H.265, H.264 (not as SEP patents she corrects, they are essential to her patents) VP8, webM, VP9 chipsets; Qualcomm chipsets, Siemens, Nokia, Apple, all MPEG-4 licensees, so writes Dr. Thomas Sikora, Berlin, former chairman of the Standards; her inventions and patents are within the China standards, India standards in AVC related fields; all digital transmitted products, and many non-digital uses too; all movies at home via Roku and Netflix, as example, Amazon, Google, TED, AppleTV, et al, as seen in your homes now, are sent not via cable or CD from Blockbuster, but via your connection and download via the narrow bandwidth of the Internet. Her invention for movies via the Internet, or books transmitted as eBooks, or whole libraries and technology to any device, is reliant upon her inventions: all music and tunes are stored or sent via her inventions. Steve Jobs working with MP3 who had via the MP3 officer under NDA, and a relationship with her team and firm, built the new then, small file size miracle: iTunes from her technology. That was then she says, but today, we’re far more relevant and current with 2013-2014 patents granted; plus new technology and coding applications, software innovations, as well as another invention that most high tech firms need.
Throughout the course of VSL’s growing successes, Ms. Nash’s gift as a strategist and dedicated manager with previous global success in other fields, made the growing of VSL Communications Ltd possible. Her colleagues she hired, the global and electrical engineer patent lawyers, codec programmers, prototype design team members, transactional lawyer David J. Perry of K & L Gates LLP, the finance and especially the decade long administrative leadership, all helped grow the company to its present success.
Ms. Nash’s efforts to disrupt the trillion dollar Mobile Wave industry, has not gone unnoticed. Last year, Worldwide Who’s Who named her Entrepreneur of the Year in the Field of Intellectual Property and Software Industry. She was also nominated for the Innovator in Technology Series for TIME Magazine in 2004.
Ms. Nash says that to her knowledge, she is the only entrepreneur male or female to create and succeed simultaneously in communications related businesses where she invented, or created the company from scratch, manufactured, engaged in contract law, P & L skill, financing, strategy, and contracted her products or services and also engaged in developing systems since 2011 in Saudi Arabia, New Zealand, Britain, China, Mexico, India, Australia, European Union, Wales, Hong Kong, and the United States—and built ‘billionaire clubs’ as her Saudi partners call VSL Communications Ltd. These achievements were for both VSL Communications Ltd., and her new successful, new non-fossil fuel company GreenEnergy Ltd working with England, Saudi Arabia, Qatar and the United States.
Her advice to younger business-focused females is to know your passion for your idea or desire, and to put it into action. Trust in yourself and act with integrity. Always trust in the opportunities that abound in today’s world. There is nothing to hold a woman back, except perhaps one thing: banks do not loan millions or even hundreds of thousands of dollars to women owner entrepreneurs, unless there is a male co-owner. I did not have a male shareholder who could attract a Venture Capital firm nor banks like those who funded Apple, or Google, or YouTube. I followed the model that Jeff Bezos used when he created Amazon: he used a formula called Friends & Family. Today, we have the TV show: Shark Tank; there are hundreds of successful female entrepreneurs pitching their successful enterprises. But note, they wouldn’t be pitching the sharks if a lending institution would step in, even after they are a proven success. On the other hand females are proving their mettle, their achievements in creating boot-strapped businesses. There are many ways forward. The first step is the one to take: trust in your vision.
