#26175 RE: AlphaInvestor8 #26174

Little confused here....from the PTAB ruling:

Patent 8145998
- New claims = 2, 3, 7, 8, 11-18

Patent 7493558
- Repeating claims = 7
- New claims = 5

Patent 7181690
- Repeating claims = 8, 13, 16
- New claims = 4

--------------------------------------------

My plan is to read and dissect the PTAB ruling sometime this weekend. A lot to sift through.

ONLY 6 INDEPENDENT CLAIMS REMAIN AS A FACT

1. What matters in patent law is independent claims

2. If I have 3 claims on 3 different patents but the 2 of the 3 claims are all identical on each patent, do I have 9 claims or do I have 5 actual independent claims? This should be self explanatory

3. If 2 claims on each patent are identical in verbiage and funcationality they only 'really' count in the legal world as 2 claims since if they are killed well they are auto killed on every patent. Sure you can 'count them on each patent' but they are the SAME.

4. 2 claims identical on each patent x 3 = 6 claims if we count, but that is semantics, it does not account for the LEGAL REALITY.

5. In actuality, there are only 2 non repetetitive claims plus the other 3, so a total of 5 independent claims

It is pathetic that some are resorting to trying to distort facts and reality here to confuse longs about their risks.

The above is an example to help people out and counter misinformation/attempts to confuse

Again, I would suggest pulling up the patents, the validated claims and reading them, you will see the EXACT same verbiage/overlap and as a result only SIX independent claims remain for WDDD as per Mr Kidrin's own words
