Ideally he should have;But, when you are fighting for your survival and can't spare the funds what can you do beyond promise to pay. I think the fact that Les put in writing that he owed the money and will pay indicates, imho, Les' and NWBO's true intentions. The additional fact that NWBO did not contest the legal claim further validates this to me. The court should side for the plantiff, Jon, and Jon should have a judgement against NWBO.
Of course, I am not a lawyer and could be way off...just my 2 cents.
