I love when you bring up VHC. I realize that they have not been paid yet and it continues to go through appeals. But do you realize what would happen to the PPS here if they won a trial for 625 million? Regardless of any appeals, the run on the news of a ruling like that would leave some of us longs very, very, well off...
No I'm not saying it's a fair deal here. What I'm saying is they've tried to use this defense once. In the deposition they argued other patents that are pieces of this one and wording. They didn't argue functionality claimed by the Chanbond patent. They are trying to say "Well if at one point this piece could only do this..." when that doesn't really matter when it's all put together. I noticed in Nettle's report he talked about that a lot but Cisco's lawyers didn't seem to want to go there. There's always a chance of losing but I don't think the chance is as great as you say it is. They are throwing darts with a blind fold on.
