They technically can say they might do a reverse split and change their minds later, but the one thing they can not do at the moment is purchase any shares before the merger is finalized or else it is considered insider trading IMO

Yes I know. I'm the one that shared that information with the board.

The point is, they are supposed to report the entire o/s. That is what 'aggregate' means.

Apparently it is not the os count , it is the shares owned by management
