No. The TA is not gagged. That implies that someone else is gagging them. And your assertion that they chose the TA because it is not reporting the share numbers is not a verifiable claim. Non-verifiable claims don't carry much water.
Re your claim that the company has indeed gagged the TA since the SS numbers are not certified by the TA - again, this may be out of the company's control if the TA simply refuses to verify any SS numbers to anybody that isn't the company.
