if this court accepts the terms that strikeforce is presenting then they are done.

I'm not an expert but reading the brief it states that the Delaware court based its findings on the previous abandoned patent, which according to the federal appeals circuit, it should not have done that in the first place.

Hardy Shook and Bacon is asking the court to take the same definitions that the Delaware court took in place BUT, this court cannot do that because there was no judgement entered, the New Jersey court has to make its own constructions.

Yes the defendant's walked into Court on a Bed of Red Hot Coals and should have Settled very early on. Now they are playing with Fire and acting like Burt Wonderstone.

Justice maybe Blind, but even the Magistrate Judge is probably thinking at this point, of the defendants, are you sure you want to proceed in dragging this out any longer.
