Because DBMM would not fight it if counsel didn't advise them to do so. It is to small a sum to settle without all the other hassles(yes the money is available). Asher has already set a precedence for these loan shark tactics and been called on it by those willing to fight. In addition, with his checkered past this was most likely an orchestrated event on his part and now undue attention would not be in his best interests.
I watched this unfold and if it weren't so sad what goes on in the OTC it would be funny. I am not here for a long time. I bought at the bottom of that dip and have doubled my money but I still believe a little more to be had here after news of it being settled surfaces.
